David Hoeser is a Veterans Disability Attorney at Berry Law in Omaha, Nebraska. A VA-accredited attorney and Veteran himself, he represents former service members who were denied disability benefits or assigned ratings that do not reflect the true impact of their service-connected conditions. His practice focuses on Veterans’ disability appeals, and he is known for combining disciplined legal analysis with firsthand understanding of the uncertainty, frustration, and emotional toll that often accompany the VA claims process. For David, these cases are never abstract legal files; they are deeply personal matters that affect a Veteran’s livelihood, family stability, access to treatment, and long-term security.
David is admitted to practice in Nebraska, the U.S. District Court for the District of Nebraska, and the U.S. Court of Appeals for Veterans Claims. Over the course of approximately six years working on Veterans disability matters, he has developed a focused, high-volume practice built on daily exposure to the legal and evidentiary issues that shape VA claims and appeals. That repetition has sharpened his ability to identify the strongest path forward, recognize the arguments that carry weight, and anticipate procedural obstacles before they undermine a case. His work has earned recognition including multiple AVVO Clients’ Choice Awards and the Martindale-Hubbell Client Champion Platinum distinction in 2025.
At Berry Law, David’s work reflects the firm’s identity as a team built by Veterans, for Veterans. He believes clients deserve not only knowledgeable counsel, but advocates who understand the system from the inside and appreciate what is at stake when a claim is delayed, undervalued, or wrongly denied. His own experience navigating the VA process gives him a practical understanding of the waiting, second-guessing, and anxiety that can define every stage of a claim from the compensation and pension exam to the final decision. That perspective informs the way he communicates with clients and the care he brings to each appeal.
David also emphasizes the procedural side of strong advocacy. He knows that timelines, continuous pursuit, and preserving appeal rights can make an enormous difference in a Veteran’s ultimate recovery, including effective dates and back pay. In his view, many Veterans lose ground not because their claims lack merit, but because the system’s rules are difficult to understand without experienced guidance. His role is to cut through that complexity, protect the claim strategically, and help clients move forward with confidence. He also brings leadership to his practice, having helped build and lead a team at Berry Law that shares his commitment to dedication, duty, loyalty, and persistent client service.
David’s commitment to this work is inseparable from his own military service. He served in the U.S. Army from 2010 to 2017 as a carpentry and masonry specialist, unit armorer, and noncommissioned officer. He deployed to Afghanistan in support of Operation Enduring Freedom from 2012 to 2013. His service earned numerous commendations, including the Army Commendation Medal, two Army Achievement Medals, the Army Good Conduct Medal, the Afghanistan Campaign Medal with Campaign Star, the Global War on Terrorism Service Medal, the National Defense Service Medal, the NATO Medal, and the Overseas Service Ribbon.
He credits the Army with instilling the values that continue to guide his legal career: dedication, duty, and loyalty. Those values shaped his path to law school and remain central to the way he serves clients today. Because he has personally gone through the VA disability process, David understands not just the law, but the lived experience behind it—the uncertainty of waiting, the worry that something important was missed, and the relief that comes when a Veteran finally receives the correct outcome. One of the most meaningful parts of his work is calling a client to say that Berry Law helped secure a 100% Permanent and Total rating. For David, those moments are powerful because they represent more than a legal win; they often mean financial security, access to benefits for dependents, and a sense that a long fight has finally ended.
His legal education built on the discipline and resilience developed during military service and positioned him to continue serving fellow Veterans in a new capacity—as an advocate working to ensure they receive the benefits they earned.
Outside of work, David enjoys spending time with his wife, daughter, and two sons. He is an avid golfer and a committed sports fan who follows Nebraska athletics closely and rarely misses NFL football. Those interests reflect the same sense of community, steadiness, and balance that he brings to his practice on behalf of Veterans and their families.
